Reasons for an Annulment
A marriage is deemed legally invalid in all cases involving incest and when a spouse is already married or in a domestic partnership. The courts can also declare a marriage invalid if the party filing for the annulment was under 18 years of age at the time of the marriage. In addition to incest and bigamy, other reasons for an annulment may include:
One, or both of the parties involved were of "unsound mind" and, thus, unable to understand what was happening at the time of the marriage
Fraud, such as when a person is seeking a green card or fails to disclose that they are unable to have children
One or both of the parties were forced into the marriage
At the time of the marriage, one of the parties was incapacitated and unable to "consummate" the marriage, with the incapacitation being deemed "incurable"
How Long Do I Have to File for an Annulment?
The state of California has a statute of limitations to file for an annulment. The period of time in which you have to file depends on the reason for the annulment. For those who got married before the age of 18, you must file within 4 years of turning 18. For marriages where fraud has been discovered, the annulment must be filed within 4 years of becoming aware of the fraud. And in the case of "unsound mind," the individual, or a relative, must file before the death of either party.
