The petitioner decides on how to end the marriage (divorce, legal separation, or annulment)
Paperwork must be filed by the petitioner
The petitioner has someone serve the forms to the spouse, now called "the respondent"
The respondent can contest the divorce if he or she so chooses
If the respondent does not contest, then the courts can end the marriage
If the respondent contests the divorce, then other legal steps must take place
Additional legal steps include an exchange of financial documents for the judge's consideration

Serving a Spouse on Base, Overseas & Stateside
With a military divorce, the location of one or both spouses can make it difficult to approach a divorce in the first place. If the spouse lives off-base, then the process follows much the same as a civilian divorce. The individual can be served the forms by a person over the age of 18 who is not connected with the case. If the spouse lives on base, a process server or sheriff can serve the papers. In situations where the spouse is stationed overseas, the individual can be served by certified mail with return receipt.
