How a Restraining Order Can Protect You
When your request for a restraining order is granted by the court, you are legally considered a “protected person.” The person you desire protection from is called a “restrained person.” If the restrained person violates the court order, he or she may face significant legal consequences including costly fines and jail time.
A restraining order can include:
Personal conduct orders
These orders prevent the restrained person from contacting, threatening, stalking, and physically or sexually assaulting the protected person. The restrained person is also not allowed to deface or destroy any property belonging to the protected person.
Stay-away orders
These orders ensure that the restricted person is forced to keep 50 or 100 yards away from the protected person’s residence and place of employment. These orders can also extend to a child’s school or child care location.
Residence exclusion orders
These orders can only be requested in domestic violence and dependent adult abuse cases. Per the restraining order, the restrained person is legally required to move out of the protected person’s residence.
