- At the time of the marriage, one of the parties was incapacitated and unable to "consummate" the marriage, with the incapacitation being deemed "incurable"
How Long Do I Have to File for an Annulment?
The state of California has a statute of limitations to file for an annulment. The period of time in which you have to file depends on the reason for the annulment. For those who got married before the age of 18, you must file within 4 years of turning 18. For marriages where fraud has been discovered, the annulment must be filed within 4 years of becoming aware of the fraud. And in the case of "unsound mind," the individual, or a relative, must file before the death of either party.
