A man who believes he isn’t a child’s biological father may seek to challenge or set aside a paternity judgment, but strict deadlines apply. Under Family Code Section 7646, a motion to set aside a judgment based on DNA evidence must generally be filed within two years of when the man knew or should have known of the judgment or of the paternity action itself, whichever comes first. Even when DNA confirms the man isn’t the biological father, the court isn’t required to set aside the judgment. The child’s best interests remain the central consideration.
