Small Claims Statute of Limitations
When filing your claim, there are deadlines that you must meet, that if passed will make your legal claim no longer valid. Deadlines vary on the type of claim that you are filing. For example, if your suit involves personal injury, you must file a claim within two years of the date that you were hurt. The same deadline is used when a spoken agreement was broken. If your suit involves property damage, you must file a claim within three years of the date that the property was damaged.
Other examples of small claims court statutes of limitations are:
- If a written agreement was broken, you must file within four years of the date.
- In suits involving fraud, you have three years to file.
- If you are filing a suit against a government agency, you typically have six months.
